2. Scope and Conclusion of Contract
This document governs the relationship between us and any person (hereinafter “Client”) purchasing, via the Site, digital content and/or physical products (together, the “Products”). Placing an order constitutes acceptance of the version of these GTC in force on the date of purchase. Any different terms apply only if expressly accepted by us in writing.
3. Products, Delivery and Shipping
Digital content and platform access: available immediately after payment confirmation via download link, streaming, email or activation of your personal account. By placing an order, you agree that the delivery of digital content begins immediately after purchase and acknowledge that you lose your statutory right of withdrawal in relation to digital content once the download or access has begun.
Physical products: shipped to Luxembourg and the EU to the address provided at order. Fees, delivery times and methods are displayed during the purchase process.
The risk of accidental loss of physical products transfers to the carrier or delivery service upon handover, unless you are a consumer – in which case the risk does not transfer until the physical delivery to you or a person designated by you, in accordance with the Consumer Rights Act 2015.
4. Prices and Payment
Prices are indicated in euros (EUR), inclusive of applicable VAT. Available payment methods are shown on our store and may include additional conditions. The contract is concluded upon receipt of our order confirmation. Access to digital content or shipment of physical products occurs after payment is received.
5. Rights to Use Digital Content
After full payment, the Client obtains a non-exclusive, non-transferable and revocable licence for personal or internal company use. Any copying, resale, public distribution or modification requires our prior written consent.
6. Refunds and Right of Withdrawal
Digital content and platform access
You may request a full refund without justification within 14 calendar days from the date of purchase. After this period, refunds are excluded.
In the event of an approved refund, your platform access will be deactivated immediately and you are required to permanently delete all downloaded copies.
Physical products
You have the right to withdraw from the purchase of physical products within 14 calendar days of receipt without giving a reason. The product must be returned unused and in its original packaging within 14 days of your withdrawal declaration to our return address. Direct return shipping costs are borne by the Client.
How to request a refund
Send an email to info@dronelicence.lu indicating your name, order number and the email address used for purchase.
Exclusions:
- No refund in case of violation of section 5 or abusive or fraudulent use of the Products.
- Your statutory consumer rights remain unaffected.
Refunds are made via the same payment method within 5–10 business days after approval or receipt of the returned product (as applicable).
7. Consumer Legal Rights
Your statutory consumer rights are not affected by these GTC. This applies in particular to your rights under the Consumer Rights Act 2015 (including provisions on quality, fitness and description of goods and digital content) and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (including the statutory 14-day right of withdrawal for distance contracts). For consumers resident in the EU, the mandatory consumer protection provisions of their respective country of residence also remain unaffected.
8. Intellectual Property
All content on the Site and digital products is protected by copyright, including under the Copyright, Designs and Patents Act 1988. Any use beyond section 5 requires our prior written permission.
9. User Content and Code of Conduct
Publishing or sharing illegal, defamatory or harmful content is prohibited. In case of violation, we may remove content and/or suspend accounts.
10. Site Availability
We aim for continuous Site availability, but technical interruptions, maintenance, or force majeure may occur.
11. Limitation of Liability
To the fullest extent permitted by law, we exclude all liability for indirect damages, consequential damages, loss of profit, loss of data or business interruption arising from the use or inability to use our Site or Products.
Our total liability for contractual claims is limited to the amount paid by the Client for the Product in question.
This limitation of liability does not apply to: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) claims under the Consumer Protection Act 1987; or (d) any other liability that cannot be excluded or limited under English law.
12. Indemnification
You agree to indemnify us against any third-party claims arising from your misuse of the Site or the Products. This clause does not apply to the extent it would be deemed unfair to consumers under applicable law.
13. Changes to the GTC
We may modify the GTC for legal or commercial reasons. You will be informed at least 14 days in advance by email or via the Site. Lack of objection or continued use of the Site constitutes acceptance of the new GTC.
14. Applicable Law and Jurisdiction
These GTC and any disputes arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to the exceptions below.
If you reside in Scotland, you may also bring proceedings before the Scottish courts. If you reside in Northern Ireland, you may bring proceedings before the Northern Irish courts.
For consumers resident in the EU, the mandatory consumer protection provisions and jurisdiction of their respective country of residence remain unaffected.
